Terms of Service
The terms that govern your access to and use of Mobilium MDM.

These Terms of Service (“Terms”) govern your access to and use of the Mobilium MDM platform, website, and related services (the “Services”) provided by Mobilium L.L.C-FZ (“Mobilium”, “we”, “our”, or “us”). By creating an account, starting a trial, or otherwise using the Services, you (“Customer”, “you”) agree to these Terms. If you do not agree, do not access or use the Services.
If you are entering into these Terms on behalf of an organisation, you confirm you are authorised to bind that organisation.
1. Definitions
- Services — the Mobilium MDM platform (cloud or on-premise), website, apps, agents, and support we provide.
- Managed Device — an Android device enrolled in and managed through the platform.
- End User — a person who uses a Managed Device.
- Customer Data — data you or your End Users provide or that the platform processes on your behalf, including managed-device data.
2. The Services
Mobilium MDM provides enterprise mobile device management for Android, including enrollment, app and policy management, kiosk mode, remote control, location tracking, monitoring, and reporting, offered as a cloud service and/or an on-premise deployment. We may add, change, or discontinue features over time.
Free trial
We may offer a 30-day free trial. Trials are provided “as is”, may be modified or withdrawn, and convert to a paid subscription only if you choose to continue.
3. Eligibility and accounts
You must be at least 18 and capable of forming a binding contract. You agree to provide accurate account information, keep it current, and keep your credentials confidential. You are responsible for all activity under your account and must notify us promptly of any unauthorised use. We recommend enabling multi-factor authentication for administrator access.
4. Subscriptions, fees, and billing
- Plans and fees. Paid Services are billed per device and/or per the plan you select. Fees, billing frequency, and currency are as quoted or set out in your order.
- Taxes. Fees are exclusive of taxes; you are responsible for applicable taxes other than taxes on our income.
- Renewal. Subscriptions renew for successive terms unless cancelled before the end of the current term.
- Late or non-payment. We may suspend the Services for overdue amounts after reasonable notice.
- Refunds. Except where required by law, fees are non-refundable.
5. Licence and restrictions
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your internal business purposes during your subscription. For on-premise deployments, additional licence terms may apply.
You will not, and will not permit others to:
- copy, modify, distribute, sell, sublicense, or create derivative works of the Services except as expressly permitted;
- reverse engineer or attempt to derive source code, except where such restriction is prohibited by law;
- circumvent usage limits, security, or access controls;
- use the Services to build a competing product; or
- remove or obscure any proprietary notices.
6. Acceptable use and Customer responsibilities
You are responsible for your use of the Services and your Customer Data, and you agree to:
- Use the Services lawfully and comply with all applicable laws, including privacy, employment/labour, surveillance, and data-protection laws in the jurisdictions where your Managed Devices and End Users are located.
- Obtain required notices and consents. Device management can include monitoring, location tracking, remote control, and remote wipe. You are solely responsible for informing End Users and obtaining any consents or authorisations required by law before enrolling or monitoring devices, and for ensuring you have the right to manage each device.
- Not misuse the Services — no unlawful, infringing, harmful, or fraudulent activity; no malware; no unauthorised access to systems or data; and no use to surveil individuals without a lawful basis.
- Secure your account and configure policies appropriately for your environment.
We may suspend Services that pose a security risk or that we reasonably believe violate these Terms or applicable law.
7. Customer Data and privacy
As between the parties, you own your Customer Data. You grant us the rights needed to process Customer Data to provide and support the Services. With respect to personal data processed on your behalf, you are the controller and Mobilium is the processor; our handling of personal data is described in our Privacy Policy and, where applicable, a Data Processing Agreement. You are responsible for the accuracy and lawfulness of Customer Data and for your configuration of the Services.
8. Intellectual property
The Services, including all software, content, and trademarks (such as the Mobilium name and logo), are owned by Mobilium or its licensors and are protected by intellectual-property laws. Except for the rights expressly granted here, no rights are transferred to you. Feedback you provide may be used by us without restriction.
9. Third-party services
The Services may interoperate with third-party products, networks, app stores, or device features. We are not responsible for third-party services, and your use of them is governed by their own terms.
10. Availability and support
We aim to provide reliable Services and reasonable support but, unless a separate service-level agreement states otherwise, the Services are provided without an uptime guarantee. We may perform maintenance and will use reasonable efforts to limit disruption.
11. Warranties and disclaimers
The Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure against every threat.
12. Limitation of liability
To the maximum extent permitted by law, Mobilium will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Services will not exceed the amounts you paid to us for the Services in the 12 months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Mobilium and its officers, directors, employees, and agents from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Customer Data, your use of the Services, your violation of these Terms, or your violation of any law or third-party right (including failure to obtain required End-User consents).
14. Term and termination
These Terms apply while you use the Services. Either party may terminate as set out in your order or for material breach not cured within a reasonable period. On termination, your right to use the Services ends, and you may export Customer Data for a limited period before we delete or anonymise it in accordance with our Privacy Policy. Provisions that by their nature should survive (e.g. intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.
15. Changes to the Services and Terms
We may update these Terms to reflect changes in our practices, the Services, or legal requirements. We will post the updated Terms here and revise the “Last updated” date; material changes may be communicated by additional means. Your continued use after an update constitutes acceptance of the revised Terms.
16. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-law rules. The parties will first attempt to resolve disputes in good faith; unresolved disputes will be subject to the competent courts of Dubai, U.A.E.
17. Force majeure
Neither party is liable for delays or failures caused by events beyond its reasonable control (e.g. natural disasters, outages, acts of government, or network failures).
18. General
These Terms, together with our Privacy Policy and any order or DPA, are the entire agreement between you and Mobilium regarding the Services. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to Mobilium should be sent to the contact details below.
